CRITICAL EMERGENCY DISCLAIMER
DrWala does NOT offer emergency medical services. In the event of an active emergency, acute chest pains, breathing crisis, physical trauma, or obstetric complications, you must immediately contact national emergency assistance (999) or transport the patient to the nearest hospital emergency room. DrWala shall not be held liable for any health complications or loss of life resulting from delays in obtaining physical emergency treatment.
1. Intermediary Services & Medical Liability Waiver
DrWala acts strictly as an online technology intermediary linking patients with independent, BMDC-registered medical practitioners. DrWala itself does not practice medicine, provide clinical diagnoses, or employ the consulting doctors as its medical agents:
- Medical Professional Liability: All clinical decisions, video diagnoses, prescriptions, treatment regimens, and health advice are the sole professional responsibility of the consulting doctor. DrWala disclaims all liability for medical malpractice, negligence, misdiagnosis, clinical errors, or incorrect medication dosage.
- BMDC Verification Limitation: While DrWala conducts screening on BMDC registrations, we make no warranties regarding the accuracy, completeness, or current status of registrations beyond our database check. Users are advised to cross-verify the doctor’s credentials.
2. Absolute Limitation of Liability
To the maximum extent permitted by applicable law in Bangladesh, DrWala, its founders, directors, officers, employees, or tech partners shall not be liable for any direct, indirect, incidental, punitive, or consequential damages. This includes but is not limited to: clinical complications, misdiagnosis outcomes, platform downtime, server-side data breaches, connection dropouts, or loss of medical records due to network anomalies.
3. Indemnification Clause
By utilizing the DrWala web applications, you agree to fully indemnify, defend, and hold harmless DrWala, its directors, and technical developers from and against any lawsuits, claims, damages, losses, or legal costs arising from: (a) your consultation outcomes, (b) accuracy errors in clinical files uploaded by you, or (c) your breach of any term outlined in this agreement.
4. Accuracy of Patient-Submitted Information
The quality of telemedicine depends on the accuracy of the details you provide. You bear full responsibility for the truthfulness and accuracy of all uploaded diagnostic reports, current prescription logs, allergies, and symptom descriptions. DrWala is not liable for clinical issues resulting from misrepresentation or omission of facts by the patient.
5. Booking, Cancellation & Refund Policy
- Full Refund Window: Appointments must be canceled at least 4 hours before the booked time slot to qualify for a full refund.
- Doctor Absence: If the doctor fails to join the virtual room within 15 minutes of the start time, the session is labeled canceled and the payment is fully refunded.
- Processing Time: Approved refunds are credited back via the gateway partner (SSLCommerz) within 5-7 business days.
6. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the People's Republic of Bangladesh. Any dispute, claim, or controversy arising out of or relating to this platform shall be settled exclusively through binding arbitration in Dhaka, Bangladesh, in accordance with the Arbitration Act, 2001.
